This session started off “on fire!” Things have died down quite a bit but there are a few pending bills. Here are a two remaining bills that could change the way we do things in HOAs:
HB 2411: OPEN MEETINGS. Boards will no longer be able to decide anything outside an open meeting and if they adjourn to executive they MUST include on the agenda a description of the specific exemption that provides the basis for that portion of the meeting to be closed. This proposed law clarifies that boards can discuss violations and assessment delinquencies in closed meetings.
SB 1072: ADMINISTRATIVE DECISIONS. When the court reviews a final administrative decision of an ALJ, the court is required to decide all questions of fact and law from scratch. That is, they cannot give any deference to the administrative judge.
